Términos del servicio

Última actualización:

Por ahora, este documento solo está disponible en inglés.

These Terms of Service ("Terms") are an agreement between you and [Company legal name] ("Podling", "we", "us"), with its registered office at [registered address]. They govern your use of the Podling mobile apps for iOS and Android, our website at trypodling.com, and related services (together, the "Service"). Please read them carefully. Our Privacy Policy explains how we handle personal data.

1. Accepting these Terms

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.

Some features may come with additional terms (for example, a promotion). If they do, we will show them to you, and they form part of these Terms.

2. Eligibility and accounts

You must be at least 13 years old to use Podling. Where local law sets a higher age for consenting to online services on your own (for example, 16 in some countries of the European Economic Area), you must meet that age or have permission from a parent or guardian.

You can sign in with Apple, Google, or an email address. You are responsible for keeping your sign-in method secure and for activity on your account. Please give us accurate information and tell us promptly at support@trypodling.com if you think someone else has accessed your account. One person per account: accounts are personal and may not be sold or shared.

3. The Service

Podling helps you learn a language by listening to public podcasts. You can search for shows by name or add a public RSS feed. Please keep the following in mind:

  • Third-party podcasts. Podcasts are created and published by independent third parties. Audio is streamed directly from the publisher's own servers. Podling does not host, re-upload, or modify podcast audio, and plays count for the publisher as normal. We do not control, endorse, or take responsibility for what podcasts say, and shows may change or disappear at any time.
  • Transcripts and translations. Transcripts are generated automatically with speech recognition unless the publisher provides an official transcript. Machine translations and word explanations are also automated. They may contain errors, especially with poor audio, strong accents, overlapping speakers, or music. Please do not rely on them where accuracy matters, and use "Report a problem" to help us improve them.
  • Changes to the Service. We are constantly improving Podling. We may add, change, or remove features. If we remove a material paid feature, we will tell you in advance where reasonably possible.

4. Subscriptions, free trials and billing

Podling offers a free plan and paid plans (currently Plus and Pro). What each plan includes is described on our pricing page and in the app.

  • Billing through the stores. Paid plans are sold as in-app subscriptions through the Apple App Store or Google Play. The store processes your payment, and its terms also apply to your purchase. Prices are shown in the app and in the store before you buy, may vary by country, and may include taxes.
  • Free trials. Plus and Pro may include a 7-day free trial for eligible new subscribers. Unless you cancel at least 24 hours before the trial ends, your subscription starts and you will be charged by the store.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel at least 24 hours before renewal. If a price changes, the store will notify you as its rules require.
  • Cancelling. You can cancel at any time in your App Store or Google Play subscription settings (see how to cancel). You keep paid features until the end of the current period. Deleting the app or your Podling account does not cancel a store subscription.
  • Refunds. Because the stores handle payment, refund requests are decided by Apple or Google under their policies. This does not affect any rights you have under mandatory consumer law.

5. AI features

Some features, including AI Talk (voice conversations about an episode), bilingual transcripts, study sheets, and word explanations, are produced by automated systems, including AI models.

  • AI output can be inaccurate, incomplete, or inappropriate. It is meant to help you practice a language. It is not professional, medical, legal, financial, or other advice. Please check anything important against a reliable source.
  • AI Talk usage is limited by plan (for example, a monthly number of minutes that resets on your renewal date). Limits are shown in the app and on the pricing page and may change with notice.
  • Please do not use AI features to create harmful, illegal, or abusive content, or try to make them reveal their internal instructions or bypass safety measures.
  • How we process your voice and conversations is explained in the Privacy Policy.

6. Your content

You can post comments on episodes and rate shows ("User Content"). You keep ownership of your User Content. By posting it, you grant Podling a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt (for example, to format or translate it), and distribute it in connection with operating, improving, and promoting the Service. This license ends when you delete the content or your account, except where it has already been shared with others or we must keep it by law.

When you post, you agree that you have the right to post it and that it does not:

  • infringe anyone's copyright, trademark, privacy, or other rights;
  • harass, threaten, or demean anyone, or contain hate speech, sexual content involving minors, or graphic violence;
  • contain spam, advertising, or misleading information, or impersonate someone;
  • contain other people's personal information without their permission.

We may review, hide, or remove User Content, and restrict accounts, if we believe it breaks these Terms or the law. You can report content in the app. If you believe we made a mistake, contact support@trypodling.com.

7. Acceptable use

Please use Podling for personal, non-commercial language learning. You agree not to:

  • scrape, crawl, or use automated means to access the Service, except as allowed by our robots.txt for public web pages;
  • copy, extract, or compile transcripts, translations, or study sheets in bulk, or republish them;
  • circumvent plan limits, usage limits, access controls, or technical protections, or share accounts to avoid paying;
  • reverse engineer, decompile, or modify the apps, except where the law allows despite this restriction;
  • use the Service to train or benchmark machine-learning models without our written permission;
  • interfere with the Service, introduce malware, or test its security without permission;
  • use the Service in violation of any law or anyone's rights.

8. Intellectual property and third-party content

Podcasts, including their audio, titles, artwork, and descriptions, belong to their respective owners. Podling gives you a way to listen to and learn from them. It does not grant you any rights in them.

The Service itself, including the apps, design, software, and our own text and graphics, is owned by Podling or its licensors. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the apps on devices you own or control, in line with these Terms and the app store rules. "Podling" and our logos are our trademarks.

If you are a podcast creator or rights holder, see our Copyright & DMCA Policy and the Creators page to claim your show, opt out, or report infringement.

9. Suspension and termination

You can stop using Podling at any time and delete your account in the app (Profile > Settings > Account > Delete account). Remember to cancel any store subscription separately.

We may suspend or terminate your access if you seriously or repeatedly break these Terms, if required by law, or if continuing would create legal risk or harm for others. Where reasonable, we will tell you why and give you a chance to respond. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnity) continue to apply.

10. Disclaimers

We work hard to make Podling reliable, but the Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, that any podcast will remain available, or that transcripts, translations, or AI output will be accurate. Podling does not guarantee any particular learning result or exam score.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

11. Limitation of liability

To the extent permitted by law, Podling and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.

To the extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid for the Service in the 12 months before the event giving rise to the claim, or (b) [amount in local currency]. These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold Podling harmless from claims, losses, and reasonable costs (including legal fees) arising from your User Content, your misuse of the Service, or your violation of these Terms or anyone's rights. This section does not apply to consumers where the law does not allow it.

13. Governing law and disputes

These Terms are governed by the laws of [governing law / venue], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [governing law / venue], unless mandatory law gives you the right to bring proceedings in the courts where you live. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.

Before filing a claim, please contact us at support@trypodling.com so we can try to resolve the issue informally.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you in the app or by email at least 30 days before it takes effect, unless the change is required sooner by law or to address security. The "Last updated" date at the top shows the latest version. If you keep using Podling after a change takes effect, the updated Terms apply. If you do not agree, you can stop using the Service and delete your account.

15. Contact

Questions about these Terms? Write to support@trypodling.com or to [Company legal name], [registered address].

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets, with notice to you.
