Copyright & DMCA Policy
Last updated:
Podling exists because of the people who make podcasts. We respect their rights, and we have designed the Service to send listeners to creators, not away from them. This policy explains how we use podcast content, what creators can do, and how we handle copyright notices under the US Digital Millennium Copyright Act (DMCA) and other laws.
1. How Podling uses podcasts
- We stream the original file. When you press play, audio streams directly from the enclosure URL in the publisher's public RSS feed. We do not copy, re-host, cut, or modify the audio, and we do not strip or insert ads. Plays reach the publisher's hosting and analytics as they would in any podcast player.
- Transcripts for learning. We create word-synced transcripts with speech recognition so learners can follow along, look up words, and practice. If a publisher provides an official transcript (through the podcast:transcript tag or our Creators page), we use it instead.
- Short excerpts on the web. Public web pages about shows and episodes show only metadata from the feed (titles, artwork, descriptions) and short excerpts of transcripts: no more than 150 words or 90 seconds of an episode per page. Full transcripts are available only inside the app, alongside the original audio.
- Attribution. We always credit the show and publisher and link to the show's own website or feed.
2. Creators' options
If you own or publish a podcast, you can, free of charge:
- Claim your show to verify ownership, update details, and see learner interest.
- Opt out. Ask us to remove your show from Podling. We process verified opt-out requests within 72 hours. See how to opt out.
- Provide official transcripts so learners see your own text instead of an automatic one.
Learn more on the Creators page or write to creators@trypodling.com. You do not need to send a legal notice to use these options.
3. Filing a DMCA notice
If you believe content on Podling infringes your copyright, send us a written notice that includes all of the following, as required by 17 U.S.C. §512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to be infringed (or, for multiple works, a representative list).
- Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it, such as the URL or the show, episode, and comment.
- Your contact information: name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Notices missing these elements may delay our response. Before filing, please consider whether the use may be authorized or a fair use.
4. Where to send notices
- Email: copyright@trypodling.com
- Designated agent: [DMCA designated agent name], [Company legal name]
- Postal address: [registered address]
Our designated agent is registered with the US Copyright Office. Please send only copyright matters to this address; other questions go to support@trypodling.com.
5. How we respond
- Review. We check that the notice is complete and identify the material. We may ask for more information.
- Remove or disable access. If the notice is valid, we promptly remove or disable access to the material: for example, hiding a transcript or excerpt, removing a show or episode from Podling, or taking down a user comment.
- Notify the user. When the material is user content, such as a comment, we notify the user who posted it and give them a copy of the notice (with your personal contact details redacted where appropriate), including how to file a counter-notification.
- Document. We keep a record of the notice and our actions, and may send a copy to the Lumen database or similar projects with personal details removed.
6. Counter-notification
If your content was removed and you believe this was a mistake or misidentification, you may send a counter-notification to the address above. Under 17 U.S.C. §512(g)(3) it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the US federal district court for your address (or, if you are outside the US, any judicial district in which Podling may be found), and that you will accept service of process from the person who filed the original notice or their agent.
We forward valid counter-notifications to the original complainant. Unless they tell us they have filed a court action, we restore the material within 10 to 14 business days after receiving the counter-notification.
7. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe. Each valid notice against a user's content counts as one strike. Accounts that receive 3 valid notices within 12 months are terminated. Strikes expire 12 months after they are issued. A strike is removed if a counter-notification leads to restoration or if the notice is withdrawn. You may appeal a strike or termination by writing to copyright@trypodling.com.
8. Misrepresentation
Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. If you are unsure whether material infringes your rights, please consult a lawyer first.
9. Notices under other laws
We also respond to notices under other countries' laws, such as the EU Digital Services Act, Japan's Provider Liability Limitation Act, Korea's Copyright Act, and the ISP safe-harbor procedure of Taiwan's Copyright Act. Send them to copyright@trypodling.com with the information required by the relevant law. We will review them under that law and, where appropriate, handle them in the same way as DMCA notices.
